1. Introductory Provisions

These Terms and Conditions govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations between the seller and the buyer arising in connection with or on the basis of a purchase contract concluded through the online store.

The seller is:

Company ID: 02459531
e-mail: lukas@krajicek.net

(hereinafter referred to as the "seller")

The buyer is a natural person – a consumer – who concludes a purchase contract through the online store outside the scope of their business activity.

The online store is operated at krajicek.net.

2. Subject Matter of the Contract

The subject matter of the purchase contract is the sale of photographs, both in digital form intended for download and as printed photographs, as well as the sale of discount vouchers.

The photographs offered by the seller are taken primarily at sporting events, in particular equestrian competitions, and are presented through online galleries.

3. Conclusion of the Purchase Contract

The buyer places an order by selecting photographs in the online gallery and adding them to the electronic shopping cart. Before submitting the order, the buyer has the opportunity to review and amend the entered information.

By submitting the order, the buyer confirms their commitment to pay the purchase price. The purchase contract is concluded at the moment the order is submitted to the seller.

The seller will subsequently send the buyer an order confirmation to their e-mail address.

4. Price and Payment Terms

The prices of the offered photographs and services are listed as final. The seller is not a VAT payer.

The buyer may pay the purchase price by cashless bank transfer to the seller's account.

The seller reserves the right to require payment of the purchase price before delivering the goods or digital content.

5. Delivery of Goods and Digital Content

Digital photographs are delivered to the buyer via a download link, either through the online photo gallery (photo bank) or through a file transfer service (e.g. Úschovna). The download link is sent to the buyer's e-mail address.

Delivery of digital photographs takes place within 3 business days of receiving payment, unless otherwise stated.

The buyer is obliged to download the digital content without undue delay after it has been made available. The seller is not responsible for the inability to download files after the expiry of their availability period.

Printed photographs are delivered via a courier service or another agreed method, with a delivery time of generally 3–10 business days from receipt of payment.

6. Discount Vouchers

The seller may offer discount vouchers that can be applied to a purchase by entering the relevant code at checkout. The validity of the voucher is time-limited and is stated at the time of issue.

A discount voucher cannot be exchanged for cash. Only one discount voucher may be applied per order, unless otherwise stated.

7. Copyright and Licence

All photographs offered by the seller are works of authorship within the meaning of Act No. 121/2000 Coll., the Copyright Act.

By purchasing a photograph, the buyer does not acquire ownership of the work, but only a non-exclusive licence for personal use.

The buyer is entitled to use the photographs for personal purposes and to share them, for example on social media. The buyer is not entitled to modify, redistribute for profit, provide to third parties, or otherwise commercially exploit the photographs without the prior consent of the seller.

Commercial use of photographs is only possible on the basis of an individual agreement between the buyer and the seller.

8. Withdrawal from the Contract

The buyer acknowledges that in the case of delivery of digital content not supplied on a tangible medium, they have no right to withdraw from the contract pursuant to Section 1837 of the Civil Code, if performance has commenced with their prior express consent.

In the case of printed photographs, the buyer has the right to withdraw from the contract within 14 days of receiving the goods. In such a case, the buyer is obliged to return the goods to the seller and bears the costs associated with the return.

9. Complaints and Rights Arising from Defective Performance

The buyer is entitled to file a complaint if the delivered photographs are defective.

In the case of digital photographs, this may include non-functional or corrupted files. In the case of printed photographs, this includes printing defects or damage during transport.

The seller undertakes to handle the complaint without undue delay, no later than 30 days from the date it is filed.

10. Specifics of Photographs from Sporting Events

The buyer acknowledges that photographs are taken at public sporting events and their nature reflects the conditions at the time of capture.

The seller bears no responsibility for the quality or content of a photograph in terms of the expression of the photographed person, obstruction by another person or object, or other circumstances beyond the seller's control.

The buyer selects photographs based on previews.

11. Preview Images and Photo Editing

Preview photographs may contain a watermark or be provided in lower quality. Final photographs delivered to the buyer are watermark-free.

Colour and light adjustments of photographs reflect the seller's artistic style and are not subject to complaint.

12. Photo Archiving

The seller retains photographs for a limited period after their publication. After this period, photographs may no longer be available for download or re-delivery.

13. Personal Data Protection

The seller processes the buyer's personal data for the purpose of processing the order and fulfilling the contract. Detailed information on the processing of personal data is provided in a separate document.

14. Out-of-Court Dispute Resolution

The competent authority for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority, with its registered office at Gorazdova 1969/24, Prague 2, website: coi.gov.cz.

15. Final Provisions

These Terms and Conditions form an integral part of the purchase contract. The legal relationship between the seller and the buyer is governed by the laws of the Czech Republic.

The seller reserves the right to amend or supplement these Terms and Conditions.

These Terms and Conditions take effect on 1 May 2026.
